Terms of Use

These terms are the agreement between you and Troiva when you use any of our apps and this website. Plain language first, legal second.

These Terms of Use (“Terms”) apply to every app and website that Troiva (“Troiva”, “we”, “us”, or “our”) offers, including Serena, Aloft, 2nd Menu, and any app we release over time (each, an “app”, and together, the “service”). By downloading, accessing, or using the service, you agree to these Terms. If you do not agree, please do not use the service.

Eligibility

You must be old enough to form a binding contract with us and to use the app where you live. Some apps, including our health apps, require you to be at least 18, and that requirement is shown in the app and its store listing. If you are a minor where you live, you may use the service only with the involvement of a parent or guardian, and only where the app permits it. By using the service, you confirm that you meet these requirements.

Your account

Most apps work without an account. If you create one, you are responsible for keeping your login credentials safe and for activity under your account. Please do not share your account with anyone.

What our apps are, and are not

Our apps are informational and wellness tools. They are not medical devices, diagnostic tools, or a substitute for professional advice. This is especially important for our health apps: they do not prescribe, dose, diagnose, or treat, and any reminders, estimates, charts, or AI responses are informational aids that can be wrong, delayed, or missed. Every decision about your health belongs with you and a qualified professional. If you may have a medical emergency, contact your local emergency services.

AI features

Some apps include features powered by artificial intelligence. AI output is generated automatically, can be inaccurate or incomplete, and should not be relied on as professional, medical, legal, or financial advice. Use your own judgment, and verify anything important.

Your responsibilities

  • Use the service lawfully and as intended.
  • Enter your information accurately. The app can only reflect what you put in.
  • Do not reverse-engineer, scrape, overload, or interfere with the service, or try to access it in unauthorised ways.
  • Do not use the service to build a competing product, or to infringe anyone’s rights.
  • Treat our support team the way you would like to be treated.

Subscriptions, billing, and free trials

Some features require a paid subscription. Subscriptions are sold and billed through the Apple App Store or Google Play at the price shown at purchase. Unless you cancel, subscriptions renew automatically for the same period, and your account is charged through your store within 24 hours before each renewal. If a free trial is offered and you do not cancel before it ends, it converts to a paid subscription.

You can manage or cancel a subscription anytime in your device’s store settings. Cancellation takes effect at the end of the current billing period, and you keep access until then.

Refunds

Purchases are handled by Apple and Google, and refunds are governed by their respective store policies. For unusual circumstances, write to hello@troiva.com and we will help where we can.

Your content and data

You keep ownership of the data you create. Where an app stores your sensitive data on your device, you are responsible for keeping your device backed up. If you delete an app without exporting or backing up, your local data goes with it. Our Privacy Policy explains how we handle data in more detail.

Intellectual property

The service, including its software, design, text, graphics, and brand, is owned by Troiva and protected by law. We grant you a personal, limited, non-exclusive, non-transferable, revocable licence to use the service for your own personal, non-commercial use. Your own data is yours. You may not copy, redistribute, or use our work commercially without our written permission.

Third-party services

The service relies on third parties such as Apple, Google, and other providers, and may link to or interact with services we do not control. Your use of those services is governed by their terms, and we are not responsible for them.

Disclaimers

The service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, to the fullest extent permitted by law. We do not warrant that the service will be uninterrupted, error-free, or fit for a particular purpose.

Limitation of liability

To the fullest extent permitted by law, Troiva will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising from your use of the service. Where liability cannot be excluded, our total liability is limited to the amount you paid us for the app in the twelve months before the claim, or, if you paid nothing, to a nominal amount.

Indemnity

You agree to indemnify and hold Troiva harmless from claims and expenses arising out of your misuse of the service or your breach of these Terms.

Termination

You can stop using the service at any time and delete your account. We may suspend or end your access if you breach these Terms or misuse the service. Sections that by their nature should survive termination, such as intellectual property, disclaimers, and limitation of liability, will continue to apply.

Governing law

These Terms are governed by the laws of the State of Israel, without regard to its conflict-of-laws rules, and the competent courts of Tel Aviv-Jaffa will have exclusive jurisdiction, unless mandatory law in your country of residence provides otherwise.

Changes to these terms

We may update these Terms from time to time. When we make a material change, we will notify you, usually in-app, before it takes effect. Continuing to use the service after a change means you accept the new Terms.

These Terms cover the whole Troiva family of apps. An individual app may add app-specific terms in its App Store listing or in-app. Where an app-specific term conflicts with these Terms, the app-specific term governs for that app.
